HMA v Ashley Duncan

Ms Ashley Duncan who was sentenced for taking part in an attempted murder has lost her in appeal against her conviction. Ms Duncan was sentenced to six years imprisonment after being found guilty of the attack on Mr Jones in Aberdeen in 2016. Her two co-accused were sentenced to eleven and eight years at the High Court in Edinburgh along with Ms Duncan.

Mr Duncan’s argument on appeal was that she was provoked and she was the victim of a miscarriage of justice. Her legal team argued that the original Trial Judge Lady Scott should have given legal directions to the jury about provocation. They continued that if this was the case the jury may have returned a verdict of a lesser charge of assault. However the judges rejected her claim. They appeal judges stated they will issue reasons for their refusal later on this year.
