A Paisley man has been jailed for nine years for a man who had broken into his flat. William McCann killed James McFall, 30, after a flat break in by the victim and another man. The offender was sitting in bed watching a film when the victim and his friend broke in.
The charge however was reduced from murder to culpable homicide. Lord Kinclaven stated at Glasgow High Court: “You acted under provocation. You struck Mr McFall once in the chest with a knife.” Adding the victims break in friend was also responsible for his death. Defence QC Thomas Ross said: “That night Mr McCann was not looking for trouble. He was in a bedroom with a woman friend watching a DVD when two men burst in.” He admitted stabbing the victim but stated in was in self-defence.
