Mr Bayoh, who died in 2015 in police custody in Kirkcaldy, will not have anyone held responsible for his death after the Crown office has confirmed that the events surrounding this do not merit prosecution. The COPFS have stated: “The Crown appreciates that the time taken to conclude this investigation has been difficult for all those involved. Following careful consideration and thorough review of all the available evidence, including submissions made on behalf of the family of the deceased, independent Crown counsel has concluded there should not be a prosecution in this case.” The Scottish Police Federation, has stated it would be happy to have an investigation in to the incident. COPFS have also made it clear however that prosecution could be possible in the future if in fact new evidence was to come to light. New CCTV evidence came to light earlier this year but it has been decided no charges will be brought.
